The CAN-SPAM Act: A Compliance Guide for Business

http://www.ftc.gov/bcp/edu/pubs/business/ecommerce/bus61.pdf

Do you use email in your business? The CAN-SPAM Act, a law that sets the rules for commercial email, establishes requirements for commercial messages, gives recipients the right to have you stop emailing them, and spells out tough penalties for violations.

Despite its name, the CAN-SPAM Act doesn’t apply just to bulk email. It covers all commercial messages, which the law defines as “any electronic mail message the primary purpose of which is the commercial advertisement or promotion of a commercial product or service,” including email that promotes content on commercial websites. The law makes no exception for business-to-business email. That means all email – for example, a message to former customers announcing a new product line – must comply with the law.

Each separate email in violation of the CAN-SPAM Act is subject to penalties of up to $16,000, so non-compliance can be costly. But following the law isn’t complicated.

(a) Definition of SPAM: We have adopted the definition of Spam set forth on the Spamhaus website at http://www.spamhaus.org/definition.html The first line of the Spamhaus definition reads: The word "Spam" as applied to Email means Unsolicited Bulk Email ("UBE").

6.3 FastLivemail takes several steps to ensure abuse of our service is kept to a minimum.

6.4 Checks and Balance: FastLivemail interviews new clients about both the origins of their mailing lists and their marketing practices in order to provide assistance and understanding of spam.

6.5 Clients who do not meet our standards are not allowed to use the FastLivemail service.

6.6 We random check each uploaded mailing lists for addresses that appear suspect like sales@, info@, etc. If we see anything suspicious, the account is frozen and the client is contacted.

6.7 E Campaigns and videoclips /emails are viewed before they can go to release. If we have any concerns, the message is frozen and we contact the client.

6.8 If you suspect a client of abusing our service (or have any questions regarding our policies), please do not hesitate to contact us at http://www.Fastlivemail.com/accountsAs noted above, all complaints are investigated, and you will receive a response detailing the action we’re taking to deal with the issue.
